Caravan Towing Services Terms and Conditions

Caravan Towing Services is a trading style of Welcome Associated Services Ltd (company registration number 07874666). In this Agreement, the following definitions apply:

  • CTS, We, Our, and Us: Refers to Welcome Associated Services Ltd trading as Caravan Towing Services, including its employees, contractors, and subcontractors.
  • Customer, You, and Your: Refers to the registered owner of the Vehicle or the person/business acting on behalf of the owner, as named at Booking.
  • Subcontractor: Any third-party hired by CTS to perform part or all of the Service. Subcontractors are independently responsible for their insurance coverage.
  • Vehicle: Refers to the car, van, trailer, caravan, or other material object specified at Booking.
  • Booking: The request by the Customer for CTS to tow a Vehicle from a Collection Address to a Delivery Address.
  • Service: The towing of the Vehicle by CTS under this Agreement.
  • Collection Address/Delivery Address: The address specified for the collection and delivery of the Vehicle.
  • Fee: The price for the Service as provided in the CTS Quotation.
  • Claims: All demands, claims, penalties, or liability, whether civil or criminal.
  • Losses: All financial losses, damages, legal costs, and other expenses.

1. General Terms

1.1 These Terms and Conditions must be accepted by the Customer prior to the commencement of the Service. The Booking form must clearly state the Collection Address and Delivery Address of the Vehicle.

1.2 Subcontracted Jobs: When the Service is subcontracted, a deposit of £50.00 is required at the time of booking. The remaining balance must be paid directly to the subcontractor/driver prior to the collection of the Vehicle.

1.3 Full Payment in Advance: In certain circumstances, such as when the Vehicle is older or there is a higher risk of the Vehicle being deemed unroadworthy, full payment will be required at the time of booking. CTS will notify the Customer in advance if this condition applies.

1.4 Payment can be made via Debit/Credit Card, PayPal, or Bank Transfer. Payments made by Card or PayPal will include a £5 transaction fee.

2. Cancellation

2.1 Cancellations for UK jobs must be received at least 28 days prior to the collection date for a full refund. For cancellations within 28 days, no refund will be provided.
2.2 No refunds are available for international collection or delivery addresses.

3. Vehicle Requirements

3.1 Vehicles must be in a roadworthy and serviceable condition and accessible for inspection at the Collection Point. CTS employees reserve the right to refuse service if the Vehicle is deemed unroadworthy, unserviceable, or inaccessible at the Collection Point.

3.2 Refund Policy for Unroadworthy or Inaccessible Vehicles: If the Vehicle is deemed unfit for towing, or inaccessible, any amount paid in excess of £250 will be refunded. No refunds will be provided for amounts up to and including £250. Should the Customer wish to arrange a new collection date, full payment and a new booking form must be submitted to CTS before the rescheduled collection.

4. Inspection and Vehicle Condition Report

4.1 CTS will complete a Vehicle Condition Report before towing, including photographs and video. The Customer (or Agent) must agree to and sign the report. Refusal to sign or failure to provide photographic evidence in case of disagreement may result in cancellation.

5. Delivery and Collection by Subcontractors

5.1 If a subcontractor handles delivery or collection, they will contact the Customer at least 24 hours in advance. Any disputes or claims during their possession of the Vehicle must be directed to the subcontractor.
5.2 The subcontractor is fully responsible for safe transport and must have their own insurance coverage. Claims related to subcontractor performance are to be made against the subcontractor’s insurance.

6. Subcontracting

6.1 CTS reserves the right to subcontract part or all of the Service. The subcontractor will be fully responsible for the Vehicle while in their possession. The Customer acknowledges that claims related to damage, loss, or other liabilities during subcontractor service must be made directly to the subcontractor’s insurance provider.

7. Liability and Claims

7.1 CTS is not liable for Claims or Losses due to:

  • Circumstances beyond our control (e.g., Acts of God, acts of war, civil commotion).
  • Electrical or mechanical breakdowns, inherent faults, or defects.
  • Damage caused by unavoidable events like stones hitting the Vehicle during towing.
    7.2 For vehicles handled by subcontractors, CTS will provide the necessary details to enable the Customer to file claims directly with the subcontractor’s insurance.

8. Vehicle Damage Claims Procedure

8.1 The Customer must:

  • Notify CTS in writing within 24 hours of any claims after delivery.
  • Provide photographic evidence and a breakdown of repair costs from an approved repairer.
  • Allow CTS to inspect the Vehicle before authorizing any repair or replacement.

9. Customer Responsibilities

9.1 The Customer is responsible for ensuring the Vehicle has a spare wheel and is in compliance with current legislation. Any unforeseen costs incurred during towing (e.g., tyre blowouts) will be met by the Customer.
